Justice Emeka Nwite of the Federal High Court, Abuja, Tuesday, approved the Department of the State Service(DSS) application to shield the identities of the witnesses that would give evidence in the trial of the five alleged Al-Shabab terrorists.
Also, the court held that it will rule on the application by the defendants on September 10.
The five defendants were alleged to be involved in the June 5, 2022 attack at St. Francs Catholic Church, Owo, Ondo State, in which over 40 worshippers died.
Justice Emeka Nwite granted the request on Tuesday while delivering in an ex-parte application filed and argued by DSS.
Arguing in an ex-perte application, counsel to DSS, Dr C. S Eze, predicated it on the need to protect the witnesses from possible attacks.
He argued that terrorism cases are so sensitive that witnesses must be protected on order of the court.
Having not opposed, Justice Nwite granted the request and ordered DSS not to reveal names and identities of those to testify in the matter.
The five accused persons are Idris Abdulmalik Omeiza, Al Qasim Idris, Jamiu Abdulmalik, Abdulhaleem Idris and Momoh Otuho Abubakar.
Over 40 people were reported to have died in the bomb attack, while over 100 others sustained injuries.
The prosecution agency is prosecuting the five defendants on a nine-count terrorism charge over allegedly being members of Al Shabab terrorist group, belonging to a cell in Kogi State.
The defendants are also alleged to have carried out the attack in furtherance of their religious ideology.
However they had pleaded not guilty.
Arguing the bail application, Counsel to the defendants, A. G Ibrahim, submitted that the accused persons have assembled reliable and responsible sureties to stand for them.
The request was however vehemently opposed by the DSS on the ground that the accuses persons may bolt away because of the gravity of the charges against them.
He urged the court to refuse the bail application and allow the defendants to remain in the DSS custody.

That you, Idris Abdulmalik Omeiza, Al Qasim Idris, Jamiu Abdulmalik, Abdulhaleem Idris and Momoh Otuho Abubakar, adults, males, with others still at large, on 30th May, 2022; 37 June, 2022 and 4 June, 2022, at Government Secondary School, Ogamirana, Adavi LGA, Kogi State and behind Omialafa Central Mosque, Ose LGA, Ondo State, respectively, attended and held meetings, where you agreed to and planned for the terrorist attack, which you carried out on 5™ June, 2022, at St. Francs Catholic Church, Owo, Ondo State and thereby committed an offence contrary to and punishable under Section 12(a) of Terrorism (Prevention and Prohibition) Act, 2022.
That you, Idris Abdulmalik Omeiza, Al Qasim Idris, Jamiu Abdulmalik, Abdulhaleem Idris and Momoh Otuho Abubakar, adults, males, with others still at large, on 05/06/2022, at St. Francis Catholic Church, Owo, Ondo State, with intent to further your religious ideology and while armed with IEDs and AK 47 rifles, did attack worshippers, held them hostage and in the process, caused grievous bodily harm to over 100 persons, including Onileke Ayodele, John Blessing, Nselu Esther and Ogungbade Peter and thereby committed an offence contrary to Section 24 Terrorism (Prevention and Prohibition) Act, 2022 and punishable under Section 24(2)(a) of the same Act.
That you, Idris Abdulmalik Omeiza, Al Qasim Idris, Jamiu Abdulmalik, Abdulhaleem Idris and Momoh Otuho Abubakar, adults, males, with others still at large, on 05/06/2022, had in your possession IEDs and AK 47 rifles, with which you attacked worshippers at St. Francis Catholic Church, held them hostage, killed over 40 persons and caused grievous bodily harm to over 100 persons and thereby committed an offence contrary to Section 2(1)(2) and (3)(v) and punishable under Section 24(1) and (2) of TPPA, 2022.
That you, Idris Abdulmalik Omeiza, Al Qasim Idris, Jamiu Abdulmalik, Abdulhaleem Idris and Momoh Otuho Abubakar, adults, males, with others still at large, on 05/06/2022, at St. Francis Catholic Church, Owo, Ondo State, with intent to cause death, did detonate Improvised explosive devices (IEDs), which led to the death of over 40 persons, including: Ajanaku John; Onuoha Deborah; Onileke Esther and John Bosede and thereby committed an offence contrary to and punishable under Section 42 (a)(ii) of Terrorism (Prevention and Prohibition) Act, 2022.

Justice Emeka Nwite of the Federal High Court in Abuja has fixed September 10 to deliver ruling in the application of five alleged
Al-Shabab terrorists’ seeking to be admitted to bail pending trial of terrorism charges against them.
The accused persons who were brought to court under tight security by operatives of
the Department of the State Service DSS complained bitterly that they had been kept in custody for three years.
After taking arguments for and against, Justice Emeka Nwite fixed September 10 to make his decision known on the matter.
Meanwhile, the commencement of trial scheduled to begin on Tuesday was shifted based on DSS request for a change of counsel.
Eze who represented DSS at Tuesday’s proceedings informed the court that a Senior Advocate of Nigeria, Adedeji Adedipe has been engaged by DSS to lead the prosecution team.
He said that a fiat, instrument of authority had been sought from the Attorney General of the Federation AGF permitting the senior lawyer to take effective control of the trial.
