A Kaduna High Court sitting in Zaria has ordered the restoration of the executives of the Social Democratic Party (SDP) and issued an interim injunction that restrains the state executives installed by former Kaduna State Governor Mallam Nasir El-Rufai.
This information was contained in an order signed by the court registrar, Zubairu Dauda, and made available to the media.
The order resulted from a motion ex parte in Suit No. KDH/Z/280/2025, brought before the court by Alhaji Adamu Idris and five others against the Social Democratic Party (SDP) and 28 other respondents.
The Appellants seek further orders from the honorable court regarding this matter. The court has ordered the following:
– The plaintiffs/applicants are granted leave to serve the originating summons and any other court processes relevant to this suit on the 1st, 2nd, and 3rd defendants/respondents in the Federal Capital Territory (FCT), Abuja, as they are outside the jurisdiction of this honorable court.
– The plaintiffs/applicants are also granted leave to serve the originating summons and other court processes on the 4th to 29th defendants/respondents by substituted means, which can be done by delivering the documents to any staff member of the 1st defendant at its Kaduna State Chapter office located at No. K9 Ahmadu Bello Way, 2nd Floor, Kaduna, Kaduna State. This is their last known place of business, or by pasting or affixing the documents at this address.
– An interim injunction has been issued restraining the defendants/respondents, their agents, privies, servants, assigns, or anyone acting on their behalf from further giving effect to the dissolution of the Kaduna State Chapter Working Committee of the 1st defendant/respondent pending the hearing and determination of the motion on notice for an interlocutory injunction.
– An interim injunction is also granted, restraining the 4th to 29th defendants/respondents, their agents, privies, servants, assigns, or anyone acting on their behalf from continuing to present themselves as the Caretaker Committee of the Kaduna State Chapter of the 1st defendant pending the hearing and determination of the motion on notice.
The presiding judge, His Lordship Justice Kabiir Dabo, issued these orders following the hearing of the ex parte motion, which was supported by a 49-paragraph affidavit presented by A. L. Yusuf, Esq., with the assistance of Professors Mohammed ESQ., Tahir Mohammed Bello ESQ., Bashir Ibrahim ESO., and Usman Sani Salihu ESQ., who represented the applicants.
The applicants have been directed to serve the enrolled court order and the originating process within a reasonable time before the return date, which is scheduled for July 24, 2025, for hearing.
