Defamation: Counsel to ex NCAA DG threatens court action against newspaper

The Former NCAA DG, Capt Musa Nuhu

The former Director General (DG) of the Nigerian Civil Aviation Authority (NCAA), Captain Musa Nuhu, has faulted a story published by the Sun newspaper of 17th  May 2024, suggesting that he will be arraigned before the Economic and Financial Crimes Commission (EFCC) on graft allegations to account for his stewardship as the DG of NCAA. 

In a statement in response to the story published by the newspaper issued  to the Citizenship Daily in Kano on Friday, counsel to Musa Nuhu, of Chamo & Isma’il Chambers, said that the publication is not only defamatory, but  false, misleading and injurious to the image and integrity of their client.

In view of the above, the lawyer  wrote “Pre-Action Notice”  to the newspaper concerning the publication titled: “EFCC to arraign suspended NCAA DG, Nuhu on graft allegations,” describing it as not factual, and is incorrect, and had caused significant harm to their client’s professional reputation and personal well-being. 

“It further showed that, under Nigerian law, defamation occurs when false statement about someone is published and causes injury to the subject’s reputation.”

“Thus, the aforementioned publication meets all the criteria, as such and accordingly, it demanded that this notification as narrated will attract lawsuit if no action is taken to correct or  retract the misleading story,” the counsel to Nuhu said.
